Verdict in the first trial for Samsung Electronics vs. Apple patent suit confirmed

A verdict in the first trial for Samsung Electronics versus Apple patent infringement suit ordering Samsung Electronics to pay $119,625,000 (approx. KRW 123.2 billion) to Apple was confirmed. Apple was ordered to pay $158,400 (approx. KRW 163 million) to Samsung in damages. As the outcome of the litigation was found as ‘both parties at fault,’ Samsung Electronics and Apple are forecast to raise a formal objection and to lodge an appeal.

According to the foreign press including the Washington Post on the 6th, the jury at U.S. District Court, Northern District of California San Jose Division ruled that both Samsung Electronics and Apple had partially infringed each other’s patents, and thus confirmed the verdict to find both parties at fault made on the 2nd.

The jury cited one 18th of the amount Apple had claimed and one 39th of the amount ordered for payment to Samsung Electronics. The compensation amount to be paid to Apple is 755 times larger than that received by Samsung Electronics.

“The fact that Samsung Electronics had willfully stolen our ideas and copied our products was disclosed,” said Kristin Huget, an Apple’s spokesperson immediately after the verdict in the first trial. “The jury’s ruling reinforces what courts around the world have already found.”

“We agree with the jury’s decision to reject Apple’s immoderate compensation claim,” A Samsung Electronics insider commented, “We also feel unfortunate that it believed Samsung Electronics had partially infringed Apple’s patents.”

He claimed, “We are vindicated that for the second time in the U.S., Apples has been found to infringe Samsung Electronics’ patents following a decision by the International Trade Commission (ITC).”

Since the verdict, either Samsung Electronics or Apple has not yet stated their official positions on actions to be taken in the future, such as a formal objection or a suit for an injunction to ban sales.

삼성전자 vs 애플 특허소송 1심 평결, 확정

삼성전자와 애플의 특허침해 손해배상소송에서 삼성전자가 애플에 1억1962만5000달러(약 1232억원)를 물어줘야 한다는 1심 평결이 확정됐다. 애플은 삼성에 15만8400달러(약 1억6300만원)를 배상해야 한다. 소송 결과가 ‘쌍방 과실’로 나오면서 양사 모두 이의제기와 항소를 할 것으로 예측되고 있다.

6일 워싱턴포스트 등 외신에 따르면 미국 캘리포니아북부 연방지방법원 새너제이지원 배심원단은 양측이 상대 특허를 일부 침해했다고 보고 지난 2일 내린 쌍방 일부 승소 평결을 확정했다.

배심원단은 애플이 요구한 금액 중 18분의 1, 삼성전자 청구금액 가운데 39분의 1을 인용했다. 애플이 받는 배상액은 삼성이 받는 금액보다 755배 많다.

1심 평결 직후 크리스틴 유게이 애플 대변인은 “삼성전자가 의도적으로 우리의 아이디어를 훔치고 제품을 베꼈다는 사실이 드러났다”며 “이번 배심원의 판단은 세계 법원이 이미 발견한 사실을 확인해준 것”이라는 입장을 밝혔다.

이에 삼성전자는 “애플의 과도한 손해액 주장을 거절한 배심원단의 결정에 동의한다”면서 “삼성전자가 애플 특허 일부를 침해했다고 판단한 데에는 유감”이라고 논평했다.

이어 “애플이 삼성전자 특허를 침해했다는 점이 미국에서는 국제무역위원회(ITC) 결정에 이어 두 번째로 입증된 것”이라고 주장했다.

양사는 평결 이후 이의제기, 판매금지 가처분소송 등 향후 절차에는 아직 공식 입장을 내놓지 않고 있다.
