It has been found that the technology most frequently used by non-practicing entities (NPEs) in raising suits against automakers is ‘vehicle control, guidance, operation or indication (vehicle control)’. Vehicle control is a smart car technology to support safe and efficient driving using various sensors and monitoring system installed in a vehicle.
According to the IPnomics report titled ‘Automotive patent war, where will it start?’ published by the Electronic Times Future Technology Research Center (ETRC), NPEs have filed suits against automakers for more than 82 patented technologies (based on USPC class, a classification system of the USPTO). Of the technologies, the one most frequently used in the suits against automotive industry is vehicle control. In fact, the patents purchased in a largest amount by NPEs were about vehicle control. NPEs have purchased a total of 188 vehicle control patents. Patents purchased by NPEs are highly likely to be led directly to lawsuits.
A NPE that has built a most powerful portfolio in vehicle control field is by far AVS (American Vehicular Science). AVS is a subsidiary specialized to automotive fields established by a notorious NPE ‘Acacia Research Group.’ Global automotive industry has cited 45 vehicle control patents owned by AVS by as many as 133 times. AVS has raised suits against 69 companies in relation to11 of its 45 patents. A large ‘patent citation count,’ which reflects the usability of a technology, means that the cited company has secured a powerful weapon for patent suits.
Blue Leaf I.P is another company to take notice of closely. This company holds a total of 98 vehicle control patents including those for joint registration with a global heavy equipments maker CNH America.
Automakers that have most frequently citied vehicle control patents owned by NPEs are General Motors (106 citations), Ford (104) and Honda (98). The cases of other carmakers citing NPEs’ vehicle control patents are also increasing rapidly. The increase in the ‘citation count’ is not irrelevant with the likelihood of ‘dispute occurrence.’
NPEs attack automakers based on their patent dispute expertise built in ICT fields. In particular, for automotive suits, NPEs are building up IP portfolios centering on highly influential technologies. As much as so, the likelihood of disputes is estimated to be large.

특허관리 전문업체(NPE)가 자동차업체를 제소하는 데 가장 많이 활용하는 기술은 ‘차량 컨트롤(Vehicle Control, Guidance, Operation, or Indication)’인 것으로 나타났다. 차량 컨트롤은 차량에 부착된 각종 센서와 모니터링 시스템 등을 활용해 안전하고 효율적인 주행을 지원하는 스마트카 기술이다.
전자신문 미래기술연구센터가 발행한 IP노믹스(IPnomics) ‘자동차 전쟁, 어디서 불붙나’에 따르면 NPE들은 82종이 넘는 특허기술(미국 특허청 분류체계 USPC Class 레벨 기준) 영역에서 자동차업체를 제소했다. 이 가운데 자동차업체 제소에 가장 많이 활용한 특허 분야는 차량 컨트롤 기술이다. 실제로 NPE가 가장 많이 매입한 특허도 차량 컨트롤 기술로 총 188건을 사들였다. NPE가 매입한 특허는 곧바로 소송으로 이어질 가능성이 높다.
차량 컨트롤 분야에서 가장 강력한 포트폴리오를 구축한 NPE는 단연 ‘AVS(American Vehicuclar Science)다. AVS는 악명 높은 대형 NPE 아카시아리서치(Acacia Research Group)가 자동차 분야에 특화해 설립한 자회사다. 글로벌 자동차업체는 AVS가 보유한 차량 컨트롤 특허 45건을 총 133건이나 인용했다. AVS는 특허 45건 중 11건으로 69개 기업을 제소한 바 있다. 기술 활용도를 반영하는 ‘특허인용 수’가 많은 것은 특허소송에 활용할 수 있는 강력한 무기를 확보했다는 의미기도 하다.
블루리프I.P(Blue Leaf I.P)도 눈여겨 봐야할 대상이다. 이 회사는 글로벌 중장비업체인 씨앤에이치아메리카(CNH America)와 공동 등록한 것을 포함해 총 98건의 차량 컨트롤 특허를 보유했다.
NPE가 보유한 차량 컨트롤 특허를 가장 많이 인용한 자동차업체는 제너럴모터스(106건), 포드(104건), 혼다(98건) 등의 순이다. 다른 자동차업체도 NPE 보유 차량 컨트롤 특허를 인용하는 사례가 급증하고 있다. ‘인용 수’ 증가는 ‘분쟁 발생’ 가능성과 무관하지 않다.
NPE는 ICT 분야에서 축적한 특허분쟁 노하우를 바탕으로 자동차업체를 공격한다. 특히 NPE는 자동차 소송을 위해 영향력이 높은 기술들을 중심으로 IP 포트폴리오를 구축하고 있어 향후 분쟁 발생 가능성이 높은 것으로 예측된다.
